Paano mag Transfer ng Titulo ng Lupa
Step1: Pumunta sa Notary Public. Mag pagawa ng Deed of Absolutely sale sa Abogado
Requirements:
- Titulo ng Lupa
- Latest Tax Declaration
- Valid ID of Seller and Buyer
- Personal Appearance ng Seller at Buyer sa Abogado mismo, if di makapunta pwede Authorize representative lang ang mag transact as long as meron itong hawak na special power of attrny.
Fees: 1-2 % ng selling price
Document to Recieved:
Pagkatapos pumunta sa Notary Public dapat may hawak na kayong Deed of Sale
Step2: Pumunta sa BIR para bayaran ang Capital Gain Tax (CGT) at Documentary Stamp Tax (DST). kailangan bayaran agad para hindi magka penalty
Requirements:
- Duly accomplished BIR Form No. 1706 ( para sa Capital Gains Tax)
- Duly accomplished BIR Form No 2000 ( Para sa Documentary Stamp Tax)
- Tax Identification Number ( TIN ng seller at buyer)
- Notarized Deed of Sale (Photocopy and Original)
- Certified True Copy of Tax Declaration
- Certified True Copy of Title
- Certificate of no improvement ( Kapag ang lupa ay walang bahay o building o iba pang structures na nakatayo
- Special Power of Attorney ( Kung representative lang ng buyer or seller ang mag transact sa BIR)
- Secretary certificate / Board Resolution ( if seller or buyer ay corporation or partnership)
Fees:
-Capital Gain Tax ( 6% ang fees sa selling price, Zonal value or fair market value ( whichever is Higher) deadline sa pag bayad ng captial gain tax ios on february 5
- Documentary Stamp Tax 1.5% ang bayad sa selling price, zonal value or fair market value whichever is higher)
Document to Recieved:
- After payment bibigyan ka ng Certificate Authorizing Registration (CAR) , usually within a week mabigay sayo after payment at ibabalik sayo ang mga original papers na pinasa sa BIR pero dapat may tatak na ito na narecieved na ng BIR
Step 3: Pumunta sa Office ng Municipal Treasurer (LGU) kung saan ang property naka locate. Mag bayad ng Transfer Tax para maka kuha ng Tax Clearance
Requirements:
- Tax Declaration
- Certified true copy ng title
- Notarized Deed of Sale
- Valid ID ng Seller at Buyer
- Special Power of attny ( kung hindi makaka punta sa Buyer or Seller)
- Secretary Certificate / Board Resolution ( kapag ang seller or buyer ay corporation or Partnership) kapag si buyer and seller naman personal mag transacy no need SPA at Secretary Certificate.
Fees:
0.5% kapag nasa municipality ang property at 0.75% naman kapag nasa cities ang property base sa selling price , zonal value or fairmarket value ( whichever is higher)
Document to Recieved:
After mag bayad mag iisue sila ng Tax Clearance and transfer Tax Reciept makukuha naman ito kaagad after process. Hindi ka makakapag process ng title kapag wala ito.
Step 4: Pumunta sa Department of Agrarian Reform (DAR) at kumuha ng DAR Clearance ito ay applicable lamang kapag agricultural ang classification ng Lupa, kung residential ang lupa skip na ang Step 4 at proceed na sa Step 5.
Requirements:
- Tax Declaration
- Certified true copy of Title
- Notarized Deed of Sale
- Certificate of Land Holdings from Municipal Assessors Office (MAO)
- Certificate of Land Holdings from Provincial Assessors Office (PAO)
- Duly Accomplished Dar Clearance application form
- Affidavit of Transferor
- Affidavit of Transferee
- Special power of attorney if authorized representative ang mag transact
- Secretary Certificate / Board Resolution (if seller or buyer is a corporation or partnership
Fees:
- Dar clearance fee 2,000
- Notarial Fee for affidavit of transferror Transferee and Dar Application form: 1,000
- Certification from MAO and PAO: 100-150 pesos.

After Payment mag iisue ang DAR ng DAR Clearance Certificate
Step 5: Pumunta sa Registry of Deeds para bayaran ang Registration Fee para sa pag lipat ng pangalan ng titulo from buyer to seller.
Requirements:
- Duly Accomplished registration form
- Original copy of Deed of Sale duly stamped recieved ng BIR
- Original Copy of Title
- Original copy of Tax Declaration
- Original copy of Certificate Authorizing Registration ( CAR) mula sa BIR
- Original Copy of Tax Clearance mula sa Munisipyo
- Original copy ng Transfer Tax Reciept mula sa Munisipyo
- Original copy of Certificate of No improvement ( kung wala ito bahay, buildings, or other improvements) mula sa assessors office
- Special Power of attrny if authorized representative ang mag transact sa ROD
- Secretary Certificate if seller or buyer is corporation or partnership
Fees:
No fixed rate pero may mga schedule of fees or bracketing na makikita sa LRA website or naka post kadalasan sa mga window ng ROD cashier
Example: kung ang selling price ng lupa ay nagkaka halaga ng 500-520k ang corresponding registration ay 3,500 more or less at other miscellaneous fees na nasa 2,000 pesos more or less
Document to Recieved:
After Payment sa ROD , mag sasabi sila kung kailan ang expected date of release ng titulo under sa pangalan ng BUYER's name
